Sex offender arrest after alleged trips to a local playground
On Friday, May 2, 2025, Detectives with the Davidson County Sheriff’s Office arrested James C. Burr, a registered sex offender for illegally being on child premises after completing an investigation. Burr is held in the Davidson County Detention Center, pending his court date in Lexington District Court, on May 29, 2025.
The arrest came after Detectives with the Sex Offender Registry Unit of the Davidson County Sheriff’s Office received information that James C. Burr had been on the property of a playground within the city limits of Lexington on multiple days in the month of April. There is no information to believe that any children were on the premises at the time of Burr’s presence. North Carolina General Statutes prohibits any registered sex offender from being within 300 feet of any property that is intended primarily for the use, care or supervision of minors.
The North Carolina General Assembly recognized that sex offenders often pose a high risk if engaging in sex offenses even after being released from incarceration or commitment and that protection of the public from sex offenders is of paramount governmental interest. The General Assembly also recognized that person who commit certain other types of offenses against minors, such as kidnapping, pose significant and unacceptable threats to the public safety and welfare of the children on the State of North Carolina, and protection of those children is of great Governmental interest. Starting in 1995, North Carolina requires any person who is a convicted sex offender who lives within the agency’s jurisdiction, to registered with the Sheriff.
